DEFINITIONS

Client denotes the individual or business engaging the services of LARO Studio, commonly inclusive of real estate agents or homeowners.

Material encompasses all photographs, videos, floor plans, 3D Virtual Tours, and any other printed or digital media generated by LARO Studio for the Client, depicting the Property.

Property refers to the real estate for which you enlist our services to film, photograph, and produce Material, encompassing the exterior, interior, and all associated structures, including the house.

Session signifies the occasion where the photographer or videographer, representing LARO Studio, arrives at the Property to conduct photography and/or videography sessions capturing its essence.

COPYRIGHT

LARO Studio owns full copyrights to all parts of the Material, all photos and raw video clips taken at the Property.

All Material produced for the Client may be used by the Client for all marketing associated with the current sale of the Property in accordance with local MLS rules.

Only the Client is authorized to use the Material. If someone else like another agent, homeowner, or stager wishes to have a copy of the Material, please have them get in touch with us so we can issue them a license.

The Material produced for the Client may not be edited in any way. If you wish to have any edits made please let us know we’ll be glad to help out.

PAYMENT

Payment must be received prior to the delivery of the Material to you. An invoice will be dispatched to you on the day of your shoot. Payment is expected upon receipt of the invoice. We accept payments via e-transfer, or credit card, with e-transfer being the preferred method.

PROPERTY CONDITIONS

The Client bears the responsibility of ensuring that the Property is clean and fully prepared for photography/filming at the scheduled time. If additional time is needed to prepare the property, we kindly request a minimum of 24 hours notice.

Should the photographer arrive and find the property unprepared, or if the photographer is delayed due to circumstances beyond their control (such as the absence of a key in the lockbox, unavailability of the agent/homeowner, ongoing construction, etc.), the photographer will depart, and a cancellation fee of $100 will be incurred. The photographer will not wait for the property to become ready.

During the Session, any pets must be contained or removed from the Property.

WEATHER POLICY

We are capable of conducting outdoor shoots in most weather conditions, with the exception of rain. Additionally, drones cannot be operated under specific conditions, including excessive wind, rain, or low cloud cover. It is the Client’s responsibility to monitor the weather forecast in advance and determine whether the Session needs to be rescheduled.

QUALITY OF SERVICE

As professional photographers/videographers, we possess the expertise to capture your property in its most flattering light. By engaging services from LARO Studio, you consent to accept the photographic, video, and editing decisions made by us. Any post-delivery changes requested to your Material will be subject to a billing rate of $50 per hour. Changes requested after 2 weeks will incur an additional archive retrieval fee of $50.

Please inform us of any special requests, specific items, locations, or rooms you wish to include or exclude, as well as any pertinent details or considerations before commencing the property shoot.

If you find the photos or videos unsatisfactory due to weather conditions during the shoot or any property-related issues (e.g., cleanliness, obstructive items, clutter, etc.) and opt not to reschedule, a re-shoot can be arranged at full price.

MATERIAL DELIVERY

Our objective is to furnish your Material within 24 hours of our return to the studio following the Session. However, there may be instances where additional processing time is necessary based on the extent of editing required, the number of photographs taken, or the quantity of services ordered. In such circumstances, we will inform you before the Session if we anticipate needing more time.

Upon receipt of your Material, we recommend storing it in a secure location and creating a backup copy. We will retain copies on our cloud service for a duration of 2 weeks, after which they will be removed. Requests for copies beyond this period will be subject to a $50 service charge.

3D Matterport Virtual Tours will remain hosted for 90 days, after which they will be archived. Extended hosting durations can be procured separately.

FORCE MAJEURE

LARO Studio, along with its agents, employees, or contractors, shall not be held liable for any costs or damages resulting from delays or failures to provide services under this agreement. Such occurrences may arise from causes beyond our control, including but not limited to Acts of God, fire, flood, explosion, earthquake, or other natural forces, war, civil unrest, accident, work stoppage, power or other mechanical failure, governmental action, acts of terrorism, or technical/communication disruption.

CANCELLING & RESCHEDULING

You agree to provide a minimum of 24 hours’ notice via phone call or text message to your cell phone if you need to cancel or reschedule the Session. Failure to provide such notice or cancelling within the 24-hour window will result in a cancellation fee of $100 being billed.

AGREEMENT

By contracting LARO Studio for photographic or video services, you are consenting to adhere to these terms and conditions. Additionally, you acknowledge that such acceptance establishes a binding contract between you and LARO Studio.
